HB25-1004 No Pricing Coordination Between Landlords
Summary: This bill prohibits a landlord, agent, representative, or subcontractor of a landlord to use the services of a pricing coordinator via subscription, contract, or other form of exchange. This bill also prohibits two or more landlords from engaging in “consciously parallel pricing coordination”, defined as “a tacit agreement between two or more landlords to raise, lower, change, maintain, or manipulate the price of rent to be paid by tenants.” This bill makes any violation of these prohibitions violations of the Colorado Antitrust Act.
CHC Position/Concerns: OPPOSED – The Colorado Housing Coalition opposes this bill based on the broad and vague nature of “pricing coordinator” and “consciously parallel pricing coordination” as defined in the bill. The broad definition has very few boundaries, which will make it difficult for property managers to navigate pricing properties. As written, this bill theoretically prohibits software such as the MLS, and does not offer any guidance on how to navigate pricing a property when pulling comparable pricing from websites such as Zillow.
CHC Advocacy Efforts:
January: the CHC voted on our opposition position, and registered our position with our lobbyist. We are participating in stakeholder meetings, dialogue with the bill sponsors, and, if necessary, will testify in the upcoming committee hearing on 1/29/2025.
February: the CHC proposed amendments to the bill and presented them to our lobbyist to allow us more negotiating power in our stakeholder meetings with the bill sponsors. Testified against the bill on 2/20.
March: Had a second stakeholder meeting on 3/14 to discuss our lingering concerns about this bill, as amended.

HB25-1010 Prohibiting Price Gouging in Sale of Necessities
Summary: This bill limits price increases on necessities to 10% over the average cost of the item over the previous 90 days.
CHC Position/Concerns: NEUTRAL – The CHC wants to see an amendment to ensure this bill does not apply to real estate and rental housing.
CHC Advocacy Efforts:
February: CHC reached out to the bill sponsors requesting an amendment to the bill’s current form to carve out long-term rentals, in addition to the approved amendments carving out short-term rentals and real estate sales.
March: This bill has been amended and now no longer impacts housing, either rentals or sales. The CHC has moved to a neutral position on this bill.

HB25-1019 Third Party Administration of Division of Housing Programs
Summary: This bill allows the Department of Local Affairs (DOLA) to continue to contract with third-party to disburse housing assistance funds.
CHC Position/Concerns: SUPPORT – The CHC is in support of this bill as it allows Landlords to continue to work with third-party entities when dealing with emergency rental assistance funds, instead of shifting that burdene back to DOLA.
CHC Advocacy Efforts:
February: The bill passed the third reading in the Senate on 2/12, and is currently awaiting signatures to become law.

HB25-1090 Protections Against Deceptive Pricing Practices
Summary: The bill requires total price disclosures during advertising for rentals, requiring that all mandatory and unavoidable fees be included in “total price”. This bill also prohibits landlords and property owners from charging certain fees, such as payment processing fees, and fees that increase over the term of a lease by more than 2%.
CHC Position/Concerns: NEUTRAL – The CHC is seeking to amend this bill, as the advertising requirements, while they work for the food and beverage industry, do not make sense for rental advertising. We fully support efforts to increase disclosure and transparency surrounding required fees and charges during the advertising and application process.
CHC Advocacy Efforts:
February: The CHC has attended multiple stakeholder meetings with bill sponsors and advisors, offering our direct feedback about advertising “best practices” for rentals, and our concerns about the overall effect of this bill on additional benefits and services property management companies offer residents as part of a lease. We have redlined the bill, and sent it with our written feedback to the bill sponsors. Testified in an amend position on 2/19.
March: We achieved a major amendment on this bill, which carves out third-party utilities from total price disclosures. With that amendment, one of our major concerns on this bill has been resolved. We have updated our position here to monitor the bill only.

Summary: This bill clarifies that rent increases up to current market rates are legal, so long as there is supporting documentation that the new rent rate is in fact in line with current market conditions.

Summary: This bill prohibits landlords from assessing a financial penalty if a lease is broken due to death of a responsible party under a lease.

HB25-1168 Protections for Domestic Violence Victim-Survivors
Summary: This bill seeks to allow personal attestation (instead of 3rd party proof) of domestic violence where rental properties are concerned. It imposes an 18-month repayment plan obligation on unpaid balances due if the victim wishes to remain in the property, requires landlords to inform tenants of their rights and if a landlord fails to do so, this could be used as an affirmative defense in an eviction hearing. Finally, landlords would not be allowed to charge tenants for damages “caused by the abuser”.
CHC Position/Concerns: AMEND – The CHC seeks to amend this bill, which fundamentally represents a lack of balance that could easily be abused by a tenant acting in bad-faith. The way the bill is currently written, it leaves property owners responsible for criminal behavior done by a resident.

HB25-1196 Landlord Procedures for Removal of Tenants
Summary: This bill rolls back language requirements around demands, from the current standard of “English, Spanish, and any other primary language” to English, and any other language a tenant indicates is their primary language at the time they enter into a lease agreement. This bill also rolls back the change to proper service from last year, and sets it back at 1 attempt at personal service before posting in a conspicuous place.

HB25-1202 Increasing Public Awareness of Mold Health Effects
Summary: This bill sets new disclosure requirements around the mold history, or potential mold history, of a property during the sale or lease process. This bill would stigmatize properties with any history of mold, even after it has been properly mitigated, as there is no cutoff or lookback period for this disclosure requirement. Additionally, this bill adds a disclosure and brochure requirement during sale and lease of a property.
CHC Position/Concerns: AMEND – The CHC seeks to amend this bill, as we do not feel the public is properly served by stigmatizing a property due to a mold event. If the mold was properly treated, mitigated, or remediated, and the underlying cause of the mold was also corrected, then there is minimal risk of new health issues for future residents.

HB25-1207 Pet Ownership in Affordable Housing Properties
Summary: This bill expands the definition of “residential property” for insurance companies, and prohibits insurance companies from cancelling coverage solely due to the presence of animals on premises. This bill also requires affordable housing companies funded by certain government programs or that receive tax credits to allow pet animals, with certain reasonable restrictions.
CHC Position/Concerns: AMEND – The CHC is seeking to amend this bill, as the “reasonable restrictions” as provided in the bill do not allow for weight restrictions, even if a property is not built with pet animals in mind.
CHC Advocacy Efforts:
February: The CHC has attended stakeholder meetings around this bill, and have raised our concerns around insurance industry reactions to these new requirements, as well as our concerns around what the bill sponsors consider “reasonable” restrictions with pet animals. HB25-1235 July Trials fo Tenant Proceedings
Summary: This bill codifies the right to jury trial in any action for possession of a rental property, and creates corresponding rules within the court system. This bill also removes the current allowance for leases to have a waiver of the right for a jury trial in cases of possession.
CHC Position/Concerns: OPPOSED – The Colorado Housing Coalition opposes this bill due to the burden in a jury trial in cases of possession would place on property owners and managers, to say nothing of the fees that residents may face if they request a jury trial and lose. This bill will expand the eviction timeline, already quite long, and place our county courts under additional strains to provide juries, courtrooms, and judges to preside over any jury trial.

March: We testified against this bill on 3/5. An amendment was accepted that allows the court to deny a jury trial request if there is “no dispute as to any material fact regarding the plantiff’s claim for possession of the premises or damages”.

HB25-1236 Residential Screening
Summary: This bill removes the current allowance for a landlord to require applicants who submit portable tenant screening reports to make them available directly from the screening company. This bill also allows portable screening reports to be up to 60 days old, and clarifies that landlords cannot require a screening report to contain credit information for a subsidy applicant.
CHC Position/Concerns: AMEND – The CHC is seeks to amend this bill, due to the potential for fraudulent reports if they don’t have to come directly from a screening company or agency. In the day of AI-generated documents, and how easy it is to create official looking documents, it is easier than ever to forge or modify these screening reports to make an application appear better than it is.

HB25-1240 Protections for Tenants with Housing Subsidies
Summary: This bill changes rent demands from 10-day demands to 30-day demands, regardless of tenant or property status, prohibits landlords from charging subsidy tenants a late fee that exceeds $20, and removes the current exemption from Source of Incom requirements for landlords with 5 or fewer units, which would require all landlords to accept housing choice vouchers.
CHC Position/Concerns: AMEND – The CHC is seeks to amend this bill, specifically the late fee clause, and the 30-day demand timeline. Tenants receiving housing subsidies already cannot be charged late fees for a housing authority’s portion of the rent, and capping late fees in an amount separate from late fees for non-subsidy tenants mandates that we treat subsidy tenants differently from non-subsidy tenants. Additionally, we do not feel that Colorado tenants benefit from additional time with a demand letter before before moving forward with an eviction, especially as many rental assistance programs will not provide or approve a tenant with rental assistance unless there is an active court case.

March: We testified agsint this bill on 3/5, requesting our amendments. This bill has been amended to remove the late fee clause, and to put back in the current exemption on source of income for small landlords. With that, this bill codifies the CARES Act in Colorado, regardless of what happens to it on the federal level. The CHC has updated our position to be opposed to this, as amended.

HB25-1249 Tenant Security Deposit Protections
Summary: This bill makes changes to current definitions around “normal wear and tear” as it applies to the security deposit, caps security deposits to 1 times the monthly rent, or a tenant’s portion of the rent, if they receive a housing voucher, requires landlords to permit payment plans on deposits of at least 6 months, and prohibits landlords from evicting a tenant based on their failure to pay the deposit. This bill also requires that landlords perform a move-out inspection with the tenant present, at tenant request, and prohibits landlords from charging for any damages that were not documented at the time of the inspection.
CHC Position/Concerns: OPPOSED – The Colorado Housing Coalition opposes this bill for the increased risk this bill creates when approving applicants for any rental property. Capping deposits limits the likelihood that a property owner or property manager will be flexible with applicants who are not as qualified, or on the bubble, and is especially a concern for applicants receiving a rental subsidy. If a tenant is not responsible for any portion of their rent, there is no deposit allowable by this bill. Additionally, this bill does not provide any allowance for damage hidden due to tenant belongings, or yard work not visible due to snow. Security deposits exist as a way to offset the risk every property owner faces each time they lease their property, and this bill does not provide any alternative safety net in the event that a tenant acts in bad faith.

SB25-020 Tenant and Landlord Law Enforcement
Summary: This bill expands the Attorney General’s authority to enforce landlord-tenant law, and grants counties, cities, and municipalities the power to bring civil and criminal actions to enforce certain state landlord-tenant laws. This bill also establishes a receivership mechanism for multifamily residential properties as a remedy for violations of certain laws.
CHC Position/Concerns: AMEND – The CHC seeks to amend this bill, as we do not feel that landlord-tenant law is a local issue. We believe it should be enforced uniformly across the state by a state authority. The Attorney General’s office is already positioned to enforce landlord-tenant law, especially after the creation of the Housing Division in the recent past. Allowing local governments and municipalities to enforce certain aspects of landlord-tenant law means these laws will not be enforced uniformly, with one city enforcing rules in a different way than another city. This is good for neither the tenant nor the property owner, and opens a landlord up to increased liability if they must follow the same law in two different manners between cities or counties.

SB25-131 Reducing the Cost of Housing
Summary: This bill repeals some recent housing laws, including statues regarding mandatory mediation for certain covered tenants. This bill also repeals and replaces changes made to the Warranty of Habitability in 2024, such as the inclusion of air conditioning units and portable cooling units to the list of appliances that a landlord must maintain.
CHC Position/Concerns: SUPPORT – The CHC supports this bill, as it seeks to remove some of the recent regulation that has impacted the rental industry, and has driven some property owners out of the housing market completely.
